Can an exchange of e-mails create a binding contract?
In Stellard Pty Ltd v North Queensland Fuel Pty Ltd, the Supreme Court of Queensland found that an email chain formed a binding contract for the sale of a roadhouse even though the negotiations were ‘subject to contract’.  This followed a similar decision earlier in the year by the Western Australian Court of Appeal in Vantage Systems Pty Ltd v Priolo Corporation Pty Ltd.
